Federal Maritime Commission levies US$1.35 million in penalties

The Federal Maritime Commission (FMC) has recovered US$1.35 million in civil penalties through two compromise agreements, reported the American Journal of Transportation. The settlements involved a vessel-operating common carrier and a non-vessel-operating common carrier accused of violating the Shipping Act.


One agreement was reached with Hyundai Glovis Co Ltd, a carrier based in Seoul, South Korea. FMC staff alleged the company provided services not in line with its published tariffs and failed to publish required rates and charges.

The practices were said to have persisted for more than a year and involved numerous shipments. Hyundai Glovis agreed to pay $1.3 million to resolve the allegations.

A separate agreement was concluded with Olympiad Line LLC, a non-vessel-operating common carrier. FMC alleged Olympiad also provided services inconsistent with its published tariffs.

Olympiad agreed to pay $50,000 in compromise of the allegations. Neither company admitted to violating the Shipping Act or Commission regulations.

The Commission said all penalty payments are deposited into the US General Fund, with FMC receiving no share of the money.
